FAQ - Chadi & Company

If you or someone you love has suffered a serious injury, you may find yourself facing an uncertain future filled with hospital stays, therapy treatments, doctors’ visits, medical bills, insurance paperwork, absences from work, and other issues. Understandably, you probably have a lot of questions; here, we have tried to address some basic questions about personal injury law.

I’ve been injured; what kinds of compensation are available to me?

Many injured people want to simply get their medical bills covered. That’s certainly important; at the outset, medical expenses will be your responsibility (with possible contribution from your health insurance), but you may be able to require another party to reimburse you for these expenses; an experienced personal injury lawyer can help you seek that compensation. In addition to medical bills, however, you may be entitled to compensation for your pain and suffering, for your loss of income (whether due to time away from work or a more long-term disability), for your loss of the ability to care for your home, and the cost of future expenses related to the accident. If someone you love has been killed in an accident, you may be entitled to death benefits, funeral expenses, and other compensation for the tragic loss of companionship you’ve suffered.

How do I know if I need a lawyer?

If you’ve been injured, you need a lawyer. While not all accidents result in legal action, it is always a good idea to consult with a lawyer to address your concerns and make sure you don’t miss out on potential insurance benefits or other compensation. Hiring a lawyer doesn’t mean you’re signing up for a lawsuit; your lawyer can be a valuable advocate in dealing with insurance claims, negotiating out-of-court settlements, and helping you understand your legal rights during a stressful situation.

Do I have to prove that someone else is at fault?

Some insurance policies may provide benefits regardless of fault. In many cases, the question of who is responsible for the accident will be relevant to determining some forms of compensation, but if you and another party were both partially at fault, you may still be able to recover some adjusted amount of compensation. Even if you think your case is straightforward, personal injury law is complex; a qualified personal injury lawyer can assess your situation and explain how the law may apply to your unique case.

Are there time limits for seeking compensation for my injury?

Yes. Insurance policies generally have timing requirements for filing claims. If you are considering pursuing personal injury litigation, there are time limits on filing a lawsuit; those limits may vary from province to province. It is always better to speak to a lawyer sooner rather than later, to ensure you preserve all of your options.

How do legal fees work?

Many personal injury lawyers operate on a contingency basis, which basically means that your lawyer gets paid only if you recover compensation for your injury. Firms vary in terms of their legal fees, so be sure you understand the financial arrangements between you and your lawyer.  For example, at the Calgary personal injury firm of Chadi & Company, we charge 33% of the amount recovered; if you don’t recover, we don’t charge a fee.

I’ve been in an accident; what are my responsibilities?

Take every available step to secure proper medical treatment for your injury. Follow through with doctor’s visits and advice, prescriptions, and therapy. This is important not just for your long-term health and your recovery, but also from a legal perspective; you want to minimize the damage you suffer as a result of the injury, and make sure that your doctor can provide important documentation about your injuries and treatment.

In addition, as your personal injury case evolves, stay in communication with your lawyer. You need to keep your lawyer updated about changes in your situation, your medical condition, and any other information important to your case. If you have questions, ask. Your lawyer should stay accessible to you, explaining your options and keeping you updated as your case progresses.
