Domestic Assault - Kruse Law

Domestic Assault is Vigorously Prosecuted in Canada

Domestic assault and domestic violence cases are aggressively prosecuted by Ontario authorities. Domestic abuse claims can result in the accused being removed from the home and strict limitations on their conduct while charges are pending. In addition to the upheaval a domestic assault charge can have on your reputation, family, and future, a conviction can mean a permanent criminal record, fines, and significant jail time.

Crown Prosecutors, Not Victims, Make the Ultimate Decisions Regarding Charges

While a victim’s allegation starts the process of prosecution, Crown Prosecutors make the ultimate decision whether to press, or ultimately drop, domestic assault charges. While not required to do so, prosecutors may ask for input from the police and/or the alleged victim, but the final determination as to whether to proceed with charges lies with them.

Consequences of a Domestic Assault Charge

After a domestic assault defendant is released from initial custody, they are usually subject to a “No Contact” order which will prohibit them from having any contact with the complainant (whether in person, by phone or e-mail, or via any other means of communication). Violating the order can have serious consequences; it will likely result in the alleged assailant’s re-arrest which will make it extremely difficult to obtain a further release on bail. Additionally, special arrangements need to be made to allow for visitation rights if children are involved in a domestic assault incident.

If you’ve been charged with domestic assault, you need to consult with an experienced criminal defence lawyer at the earliest opportunity. A skilled defence lawyer will understand the complexities of the law and explain the options that may spare you from the more severe consequences of a domestic assault conviction. Early intervention programs, for example, may give you an opportunity to resume contact with the complainant as long as you agree to participate in counseling on matters concerning domestic violence and relationships.
